Bay Area man accused of lewd acts in front of students unfit for trial, report says

A man accused of lewd acts in front of students at Mill Valley Middle School is mentally unfit to stand trial, according to a psychological evaluation submitted in Marin County Superior Court.

Judge Geoffrey Howard received the report about Derrell Bland on Wednesday and set a hearing for Feb. 2 on the mental competency issue. Howard had asked in November for a mental health specialist to evaluate Bland because of erratic behavior in the courtroom.

Bland’s defense attorney, Kevin Heaney, declined to comment Wednesday.

Bland, 33, is charged with felony false imprisonment along with misdemeanor counts of indecent exposure and annoying or molesting minors. The charges stem from an Oct. 30 incident when Bland allegedly trespassed on campus and entered a girls’ restroom.

Bland is accused of blocking the exit, exposing himself and performing a lewd act in front of two 11-year-old students.

Mill Valley police initially cited Bland on suspicion of trespassing and released him. However, after receiving more information about Bland’s alleged conduct, police arrested him again the next day.

Mill Valley Middle School subsequently boosted its security by hiring a second campus supervisor.

During a hearing in November, Howard ordered Bland to be held without bail, citing a history of criminal convictions and skipping court dates. Howard has suspended criminal proceedings while the mental competency issue is addressed.

The Marin County Jail booking log lists Bland as a resident of Mill Valley.
