San Jose: Police arrest suspect in fatal August shooting

SAN JOSE — A Central Valley man has been arrested in an August shooting death near a busy East San Jose intersection, police said.

The shooting was reported around 1:40 a.m. on Aug. 26 at Story and King roads, according to San Jose police. Responding officers found a man in a parking lot suffering from gunshot injuries.

He was taken to the hospital, where he was pronounced dead; he has since been identified by the Santa Clara County Medical Examiner-Coroner’s Office as Carlos Rodriguez-Gastelu, 44, of San Jose.

An ensuing investigation identified 46-year-old Sergio Loya, a Stockton resident, as the shooting suspect, authorities said. On Friday, police located and arrested Loya in Stockton.

Loya is being held without bail in the Santa Clara County Main Jail; he was criminally charged Monday, court records show.

Police did not disclose the circumstances leading to the shooting, saying Wednesday that those elements are under investigation. The death marked the 23rd homicide of the year investigated by San Jose police.
