SAN JOSE — A man has died from injuries he suffered after a garbage truck driver hit him in an early-morning collision last month, police said.
The collision was reported at 6:11 a.m. on Jan. 22 at McKendrie and Elm streets, near the lacrosse and soccer fields for Bellarmine College Prep off West Hedding Street, according to a San Jose police news release issued Thursday.
A traffic investigation determined that the driver of a white garbage truck was turning from southbound Elm Street onto westbound McKendrie Street when he hit a man walking in the roadway.
The driver stopped at the scene; the victim was taken to a hospital with life-threatening injuries, and police said he was initially in stable condition. But he died from his injuries Jan. 26. He has since been identified by the Santa Clara County Medical Examiner-Coroner’s Office as Silvino Eloy Garcia, 59, of San Jose.

The police news release states that Garcia was in an unmarked crosswalk when he was hit by the truck. In California, crossings at nearly any perpendicular intersection are considered legal crosswalks, regardless of whether they are marked on the street.
There is no indication that the driver was arrested or cited. Police did not name the company operating the truck, and declined to provide that information when asked by this news organization.
This marked the city’s sixth roadway death of the year, and the fourth to involve a pedestrian victim.
